Abstract
Spanish Abstract: Los diferentes ámbitos normativos que coexistían en Hispanoamérica y Filipinas entre los siglos XVI y XVIII consideraban al injuriante como aquella persona que lesionaba intencionalmente la fama de otro, incurriendo en pecado venial o mortal y recibiendo una pena por su delito. Junto con estudiar los elementos centrales que configuraban la injuria, en este trabajo se releva la importante discusión en torno a los requisitos de calidad de la persona que podía considerarse injuriada. Se observa que la consideración de los indios como potenciales injuriados y, por tanto, poseedores de honra, constituye una de las adaptaciones más notables del concepto hispano de honor a la realidad americana. Asimismo, se abordan las definiciones y adaptaciones de la noción de daño, las que se comprendían a partir de la Ley Aquilia, como la disminución o privación del patrimonio. De este modo, se concluye que la historia de la injuria en el contexto colonial de Hispanoamérica y Filipinas será una historia de pervivencias, traslaciones y adaptaciones a los contextos locales.
English Abstract: The different normativities that coexisted in Latin America and the Philippines between 16th and 18th centuries considered offenders here as persons who had intentionally injured another person's reputation, incurring venial or mortal sin and receiving a penalty for their crimes. As well as studying the key elements that constituted this type of injury, this paper examines when a person could be considered injured. It also observes that the consideration of Indians as persons who could potentially be injured in this way and therefore as persons who held honor, constitutes one of the most notable adaptations of the Hispanic concept of honor to the American context. It also analyzes definitions and changes to the notion of damage, which were understood as the decrease or deprivation of patrimony. Thus, it concludes that the history of injury in the context of Latin America and the Philippines is a history of survivals, translations, and adaptations to local realities.
