Abstract

Serbian Abstract: Rad razmatra pravnu prirodu obaveze predujmljivanja arbitražnih troškova, raspodelu te obaveze među strankama u pravilnicima arbitražnih institucija i posledice neispunjenja takve obaveze od strane jedne od stranaka u sporu (po pravilu tuženog). Rad se fokusira na posledice tretiranja obaveze kao materijalnopravne, te problemima iznalaženja pravnog osnova zahteva za povraćaj sredstava u svetlu uporednopravnih zakonskih propisa i pravnih odnosa koji povodom sprovođenja arbitražnog postupka nastaju između stranaka, ali i između stanaka i/ili arbitara i arbitražne institucije. Rad analizira uporednopravna rešenja ovog problema i predlaže rešenje koje bi bilo najprihvatljivije (odnosno najmanje neprihvatljivo) u našem pravu, kao i mogući način da se težina pitanja relativizuje u praksi.

English Abstract: This paper examines the legal nature of the obligation to advance the costs of arbitration, the way and manner in which institutional rules distribute burden of satisfying such obligation between the parties, and the consequences of non-fulfillment of such obligation (the defaulting party is, as a rule, the respondent). A particular focus is given to the consequences of treating the obligation as a procedural or material one, the ensuing problems of identifying the legal ground for granting reimbursement for costs advanced in lieu of the defaulting party, in light of comparative legislative solutions, and in light of the legal relationships which arbitration agreements establish between the parties and/or arbitrators and arbitration institutions. Upon examining comparative solutions, the paper proposes a solution which appears to be the least problematic in the context of Serbian law, and offers further insights on how resulting conceptual problems may be relativized in practice.
