Abstract

Progressive administrative law scholars should claim the Administrative Procedure Act as a document that reflects a progressive history, progressive inspiration, and progressive development over time. To do that, we should follow our colleagues in constitutional law who have appropriated textualism and shaped it into a progressive mode of analysis.
