Abstract

Romanian Abstract: Ierarhizarea valorilor juridice precum și a drepturilor fundamentale se poate realiza cu ajutorul legislației aplicabile, a interpretării principiilor dreptului și utilizând jurisprudența națională relevantă (în special, în cazul acestui studiu, din România) precum și de la nivel european, prin hotărârile pronunțate de Curtea de Justiție a Uniunii Europene și Curtea Europeană a Drepturilor Omului. Regulamentul general privind protecția datelor respectă toate drepturile fundamentale, libertățile și principiile recunoscute în Cartă astfel cum sunt consacrate în tratate, în special respectarea vieții private și de familie, a reședinței și a comunicațiilor, a protecției datelor cu caracter personal, a libertății de gândire, de conștiință și de religie, a libertății de exprimare și de informare, a libertății de a desfășura o activitate comercială, dreptul la o cale de atac eficientă și la un proces echitabil, precum și diversitatea culturală, religioasă și lingvistică. O lungă listă de drepturi sunt apreciate chiar de legiuitorul european în preambulul Regulamentului, că ar putea interfera cu dreptul la protecția datelor. Analiza critică este întemeiată pe jurisprudența recentă a Curții de Justiție a Uniunii Europene și a Curții Europene a Drepturilor Omului, precum și a instanțelor române, fiecare dintre acestea fiind implicate în procesul de decizie cu privire la prevalența valorilor fundamentale referitoare la libertatea de exprimare și protecția datelor.

English Abstract: The hierarchy of legal values and fundamental rights can be achieved with the help of applicable law, interpretation of principles of law and using relevant case law at national level (especially in this case, from Romania) as well as at European level, through the judgments given by the Court of Justice of the European Union and the European Court of Human Rights. The General Data Protection Regulation (GDPR) respects all fundamental rights and freedoms and principles recognized in the Charter as enshrined in the Treaties, in particular respect for private and family life, residence and communications, protection of personal data, freedom of thought, conscience and religion, freedom of expression and information, freedom to conduct business, the right to an effective remedy and a fair trial, as well as cultural, religious and linguistic diversity. A long list of rights appreciated even by the European legislator in the preamble to the Regulation that could interfere with the right to data protection. The critical analysis is based on the recent jurisprudence of the Court of Justice of the European Union and of the European Court of Human Rights, as well as of the Romanian courts, each of them being involved in the decision process regarding the prevalence of fundamental values regarding freedom of expression and protection data.
