Abstract

French Abstract: La privation de liberté est généralement associée à la notion de sanction et même lorsque ce n’est pas le cas, elle est très souvent ressentie comme telle par les individus qui en font l’objet. Par conséquent, de forts enjeux humains sous-tendent cette mesure administrative qui doit en principe rester exceptionnelle et qui s’inscrit dans un cadre légal strict où se superposent les exigences du droit de l’Union et celles du droit luxembourgeois.

English Abstract: Deprivation of liberty is classically connected with the notion of a sanction. Even when it is not so, it is often experienced as such by individuals. Much is therefore at stake when administrative authorities decide to send someone into detention. The measure must in principle be exceptional and it is governed by a strict legal framework, made of both EU and Luxembourgish legislation.
