Abstract

תקציר בעברית: האודיסאה, אפוס ארוך במתכונת שיר-עלילה המיוחס להומרוס, שנכתב, כנראה, בין השנים 700-750 לפנה"ס, נתפסת כטקסט תרבותי ואמנותי ראשון במעלה. עם זאת, היא אינה נתפסת בדרך כלל כמתקשרת לנרטיב של כינון המשפט. האוריסטיאה, כינוייה של טרילוגיה שהעלה אייסכילוס בשנת 458 לפנה"ס, שיש הרואים בה את היצירה הגדולה ביותר של הדרמה היוונית היא הנתפסת כזו המגוללת סיפור משפטי מכונן, המתאר את המעבר משלטון נטול משפט לעבר שלטון החוק.

חיבור זה מבקש לגשר על הפער האמור ולתאר, את הנרטיב המשפטי המכונן כרצף . על פי הקריאה המוצעת כאן, המתמקדת בזיקות וקשרים בין מאפיינים פואטיים, נרטיביים, פרפורמטיביים והיסטוריים הקשורים לכל אחת מהיצירות, לאודיסאה נודע תפקיד במסע לעבר הסיפור המשפטי המכונן.

לאחר שרטוט של ציר הזמן המשוער הרלוונטי ליצירות ולאירועים העומדים במרכזן, מעלה המאמר הצעה לקריאת התכתבות בין האודיסאה לבין האוריסטיאה, המתייחסת לרעיון המשפט ושלטון החוק, תוך התמקדות בגורמים שהצטברותם אפשרה צמיחה של נרטיב משפטי מכונן באוריסטיאה. המאמר אף משליך אור דמותה של האלה אתנה, הממלאת תפקיד מהותי בשתי היצירות – שיפוטי, מעין שיפוטי וגישורי. סיכום הדברים מפרט, ברוח פרדיגמת הספרות לצד המשפט, את המשותף לאופן שבו עולה דמותו של המשפט משני הטקסטים כתופעה שגלומים בה גם פוטנציאל לפתרון מיטבי של קונפליקטים ולצדק, אבל גם כשלים מובנים.

English Abstract: The Odyssey, a long epos attributed to Homer, composed supposedly between the years 750-700 BC, is perceived as a primary cultural and artistic text. However, it is not usually associated with a generative legal narrative. The Oresteia, which was first performed in 458 BC, and some see it as the greatest work of Greek drama, is the one highly associated with a generative legal narrative, that tells the story of a pre-law society and the transition into the rule of law.

This article wishes to bridge this gap and describe the generative legal narrative as a sequence. The reading offered here focuses on connections between poetic, narrative, performative and historic characteristic associated with each of these pieces, and sees the Odyssey as having a function in time, towards the generative legal narrative.

Upon drawing a speculated timeline for the pieces and the events occurring in them, the article offers a reading of correspondence between the Odyssey and the Oresteia, which relates to the concept of law and the rule of law, while focusing on the accumulating elements which enabled the growth of a generative legal narrative in the Oresteia. The article also sheds a light on the character of Athena, which plays an essential role in both pieces – as a judge, as an authority and as a mediator. The summary employs the literature alongside law paradigm in order to describe how both works portray law as a phenomenon which can resolve conflicts and bring justice, but also has structured malfunction.
