Cidadania Sexual em África: repensar formas de inclusão em Moçambique (Sexual Citizenship in Africa: Rethinking Forms of Inclusion in Mozambique)

Abstract

Portuguese Abstract: A cidadania é um estatuto jurídico entre estado e os Indivíduos, cujo vínculo traduz-se na fruição de direitos e obrigações e que define a pertença dos indivíduos numa determinada comunidade política. No entanto, na década de 80 do século XX, novas demandas sociais relacionadas com o género e a orientação sexual colocam pressão na cidadania enquanto mecanismo de inclusão dos indivíduos marginalizados na comunidade política. neste sentido, surge o conceito de cidadania sexual, teoria relativa às demandas por direitos sexuais e livre expressão da sexualidade na esfera pública. Se na Europa,Estados Unidos da América e alguns Estados da América latina a resposta do estado tem sido por um reconhecimento progressivo destes sujeitos como titulares de direitos que, até então, lhes estavam vedados, tais como o acesso ao casamento civil e à adoção, no continente Africano, com exceção da África do Sul, a hostilidade política e social para com as minorias sexuais exclui estes indivíduos da esfera pública e do exercício da cidadania. Este ensaio procura perceber como o Estado Africano regula questões relativas à orientação sexual, tomando Moçambique como caso de estudo.

English Abstract: Citizenship is a legal statute between the state and the Individuals, whose link translates into the enjoyment of rights and obligations and which defines the belonging of individuals in a given political community. However, in the 1980s of the 20th century, new social demands related to gender and sexual orientation put pressure on citizenship as a mechanism for the inclusion of marginalized individuals in the political community. in this sense, the concept of sexual citizenship emerges, a theory related to the demands for sexual rights and free expression of sexuality in the public sphere. If in Europe, the United States of America and some Latin American states the response of the state has been for the progressive recognition of these subjects as holders of rights that, until then, were forbidden to them, such as access to civil marriage and adoption, on the African continent, with the exception of South Africa, political and social hostility towards sexual minorities excludes these individuals from the public sphere and from exercising citizenship. This essay seeks to understand how the African State regulates issues related to sexual orientation, using Mozambique as a case study.
