Abstract
Russian Abstract: Нормы еврейской традиции содержали основные требования надлежащего правового процесса – презумпцию невиновности, состязательность процесса и необходимость доказывать злой умысел в уголовном процессе за тысячу (или тысячи) лет до того, как эти нормы на некоторое время утвердились в цивилизованных странах. Отдельно разбирается проблемная норма «Заведения под свод», как будто игнорирующая эти требования и в связи с этим почти не упоминающийся в еврейской традиции суд царя (государственный суд – основа реально действующей судебной системы). Также разбираются два прецедента судов царя Давида. Показано почему они не облегчают работу обвинения в большинстве дел, но могут помочь в делах гордых террористов.
English Abstract: Jewish traditional Law (Halacha) contained all classical components of ‘Due Process of Law’ – presumption of innocence, competitive process with strong legal defense and duty of prosecutor to prove criminal intent in the cases of severe crimes - many centuries before modern legal practices in the Rule of Law countries. Special attention is paid on ‘Placing in a cell’ law ‘as if’ breaching the regular norms of Jewish legal process norms. Regarding this case the court of the King (state’s court system – the main structure of the really acting Judiciary) almost missed in the mainstream of Jewish tradition is discussed in the paper. Two cases of king David's given judgments – death sentences are analysed. The explanation is provided why these precedents can’t help modern prosecution with notable exemption in the cases of proud terrorists.
