Israeli Perspectives on Alternative Dispute Resolution and Justice

Abstract

English Abstract: Israel is a highly litigious country and a world leader in the number of cases filed per capita. The combination of high volume of cases and a relatively small judiciary have contributed to an overburdened legal system infected with delays in the delivery of judgments. In addition, Israeli society is highly diversified, with dissimilarities among sections of society that lead to social disagreements and rifts between groups. Recently, Israel State Comptroller observed in a special report that "These divisions have changed the face of Israeli society … Expressions of racism and violence, bigotry, persecution and even crimes of hatred have become not-quite-so rare occurrences."

The Article explores the justice goals of ADR in Israel, assesses whether they have been achieved, and considers the future of ADR and Justice in Israel.

The Article identifies two visions of justice in ADR discourse in Israel: a narrow sense of justice as effective, quick, and cheap resolution of legal disputes; and a richer concept of justice beyond effectiveness, which seeks to offer a more comprehensive and complex response to conflicts, and promote a better society, based on values of tolerance, dialogue, and consent. The different visions of justice are illustrated in the context of several particular areas in which ADR developed in Israel, including the court system, community mediation, the education system, environmental conflicts, and complaints against public bodies. The success of these ADR initiatives is evaluated with reference to a large variety of sources, including scholarly articles, Governmental Ministries' annual reports, State Comptroller and Ombudsman reports, Knesset (Parliament) protocols, Court Administration statistics, policy papers, and media articles. Though the evidence points to a very modest impact on the Israeli justice system and social climate, the Article identifies exciting and positive developments growing out of both state (legislative and other) actions and private initiatives that could make greater impact on Israeli justice system and society in the future.

תקציר בעברית: ישראל היא מובילה עולמית במספר ההתדיינויות המשפטיות לנפש. השילוב בין מספר רב של תיקים משפטיים לבין מערכת שיפוט קטנה יחסית תורמים לעומס הרב על מערכת המשפט ולעיכובים במתן פסקי דין. בנוסף, החברה הישראלית מגוונת מאוד, וההבדלים בין חלקי החברה השונים מובילים לאי הסכמות, מתחים, ושסעים בין קבוצות. לאחרונה, ציין מבקר המדינה בדו"ח מיוחד כי "שסעים אלו שינו את פניה של החברה הישראלית ... התבטאויות גזעניות ואלימות, הפליה, רדיפה ואף פשעי שנאה מזעזעים היו למחזות שאינם כה נדירים."

המאמר בוחן את יעדי הצדק של יישוב הסכסוכים החלופי (ADR) בישראל, מעריך אם הושגו, ומתייחס לעתידם של יישוב הסכסוכים החלופי והצדק בישראל. המאמר מזהה שתי תפיסות של צדק בשיח יישוב הסכסוכים החלופי בישראל: תפיסת צדק צרה, המתייחסת לצדק כאל יישוב סכסוכים יעיל, מהיר וזול; ותפיסה עמוקה יותר של צדק מעבר ליעילות, המבקשת להציע מענה מקיף ומורכב יותר לסכסוכים ולקדם חברה טובה יותר, המבוססת על ערכים של סובלנות, דיאלוג והסכמה. תפיסות הצדק השונות מומחשות בהקשר של מספר תחומים ספציפיים שבהם התפתח יישוב סכסוכים חלופי בישראל, לרבות מערכת בתי המשפט, גישור קהילתי, מערכת החינוך, סכסוכים סביבתיים, ותלונות כנגד גופים ציבוריים.

מידת ההצלחה של יוזמות יישוב סכסוכים חלופי אלה מוערכת בהתייחס למגוון גדול של מקורות, לרבות מאמרים אקדמיים, דו"חות שנתיים של משרדי ממשלה, דו"חות מבקר המדינה ונציב תלונות הציבור, פרוטוקולים של הכנסת, סטטיסטיקות של הנהלת בתי המשפט, מסמכי מדיניות ודיווחים בתקשורת. למרות שהראיות מצביעות על השפעה צנועה ביותר על מערכת המשפט ועל האקלים החברתי בישראל, המאמר מזהה התפתחויות חיוביות הנובעות הן מיוזמות של המדינה (כגון חקיקה) והן מיוזמות פרטיות, שעשויות להיות להן השפעה רבה יותר על מערכת המשפט והחברה בישראל בעתיד.
