A Era Das Máquinas Criativas: A Proteção Patentária De Invenções Geradas Por Sistemas De Inteligência Artificial (The Era of Creative Machines: Patent Protection for Inventions Generated by Artificial Intelligence Systems)

Abstract

Portuguese Abstract: O texto analisa o fenômeno das invenções geradas por sistemas de inteligência artificial (IA), sem que um inventor humano possa ser identificado, e a possibilidade de conferir patentes para tais invenções. Toma-se, como ponto de partida, a decisão do Escritório Europeu de Patentes em relação às invenções geradas por Dabus, um sistema de IA. Identifica-se o conceito de inventor no Brasil, Reino Unido e Estados Unidos e, em seguida, avaliam-se argumentos contrários e favoráveis ao reconhecimento da qualidade de inventor às máquinas. O tópico final analisa se a concessão de patentes a invenções geradas por sistemas de IA é necessária como um incentivo para a pesquisa e o desenvolvimento, sob a ótica da Análise Econômica do Direito. Conclui-se que, seja qual for o caminho trilhado – alteração das legislações de propriedade intelectual para este tipo de invenção, ausência de proteção patentária ou uma terceira hipótese –, é crucial que haja diálogos em âmbito internacional, para uma compreensão e tratamento uniforme do tema.

English Abstract: The text analyzes the phenomenon of inventions generated by artificial intelligence (AI) systems, under circumstances in which no human author or inventor can be identified, and the possibility of granting patents for such inventions. It is used, as a starting point, the decision of the European Patent Office regarding the inventions generated by Dabus, an AI system. The article identifies the concept of inventor in Brazil, in the United Kingdom and in the United States and analyses the arguments against and in favor of recognizing the machine as the inventor. The final topic analyses whether granting patents to inventions generated by AI systems is necessary as an incentive for research and development, from the perspective of the Law & Economics. It is concluded that, whatever path is taken - amendment of intellectual property laws, absence of patent protection or a third hypothesis -, dialogues at the international level are crucial to produce a uniform approach of the issue.
