Abstract
תקציר בעברית: סקירת החידושים אשר הביאה עימה שנת המשפט תשע"ד בתחום המשפט הציבורי עוסקת בארבע תימות מרכזיות: יחסיות המשפט הציבורי, עלייתה של החשיבה הקבוצתית באשר לזכויות הפרט, מגבלות ההגנה על עקרונות המשפט הציבורי ובכלל זה זכויות במצבי קיצון, וכן המתח שבין הדמוקרטיה לבירוקרטיה, אשר עולה בין השאר בתחום יחסי שלטון מרכזי–שלטון מקומי. באשר לשאלת היחסיות, הסקירה מראה כיצד מרבית מרכיביו של המשפט אם לא כולם –הציבורי – עוברים תהליך של יחסיות. במסגרת תהליך זה הכללים החלים על קביעת גדרי סמכותה של הרשות (המבצעת או המחוקקת), הכללים החולשים על ההליך שבמסגרתו מפעילה הרשות את כוחה המשפטי וכן העקרונות שלפיהם על הרשות להפעיל שיקול דעתה – כולם הולכים והופכים יחסיים במובן זה שמעל כולם מרחפת מעין מדתיות כללית. כך, גם בהקשר הסעדים. מבחינה נורמטיבית, מציעה הסקירה לעגן במפורש חזקה לפיה דבר דין (חוק, חקיקת משנה, צו כללי או צו אישי) אשר נפל פגם משמעותי יוחזק כבטל, אלא אם יקבע בית המשפט אחרת. באשר לשאלת ההבניה של הזכויות, מציעה הסקירה, לאחר תיאורה של מגמה אפשרית זו, לחזור למושכלות ראשונים ולהכיר בזכויות פרט גם במקום שבו אין מדובר בהקשר חברתי המשייך זכות כזו או אחרת לקבוצה מוחלשת (ובלבד שאכן מדובר בפרט שאין בידיו כלים כאלה ואחרים להפעיל מנופי השפעה על הרשות). באשר ללחץ אשרלוחץ מצב החירום את כללי המשפט הציבורי, מראה הסקירה כיצד נאלצים בתי המשפט לתמרן באופן יישום כללי המשפט, וקוראת להקפדה ראייתית, שמא אין המדובר בלחץ הנובע ממצב החירום עצמו אלא בלחץ הנובע מתחושת החירום, מבלי ששיש בהכרח בתחושה זו כדי להצדיק פגיעה בכללים, לרבות זכויות, אשר נועדו דווקא להגן מפני תחושות חירום כאלו ואחרות. הסוגיה הראייתית אינה מיוחדת למצבי החירום: הסקירה מראה כי, כשאלת חתך, יש צורך לחשוב מחדש על האופן שבו ניתן לבסס תשתית ראייתית בפני בתי המשפט העוסקים בשאלות מתחום המשפט הציבורי, שכן לעיתים סוגיות ראייתיות נמצאות בלב המחלוקת, ובעידן שבו בתי המשפט לעניינים מנהלייםנושאים בנטל הליטיגציה ניתן לחשוב על פתרונות שמאפשרים בירור מחלוקות ראייתיות. ולבסוף, סקירה זו מראה כי נדרש עיון מחדש בהיבטים שונים ביחס שבין השלטון המקומי לשלטון המרכזי, כסוגיה ספציפית הקשורה ליחס שבין שלטון נבחר לגורמי המקצוע ובין שאלות שאופין כלל- ארצי לשאלות שבהן ישנו ערך בריבוי גישות. עניין זה בעל חשיבות מיוחדת בעניינים הקשורים לשבת ולהיבטים נגזרים של הזכות לתרבות. בהקשר זה, כמו גם בהקשרים אחרים, סוגיית מעמדו של היועץ המשפטי לרשות מצריכה המשך מחשבה, מתוך הבנת חשיבותו כשומר סף.
English Abstract: The majority of the important developments that were introduced to the Israeli public law in 2014 could be grouped under four major headings: The relativization of Israeli public law; the rise of a group-based approach to individual liberties; the limitations of protecting basic public-law principles under extreme conditions; and the tension between representative-democratic and the professional-bureaucratic justifications for the interpretation and application of public law principles, particularly as evidenced in the relationships between the central and the local governments in Israel. Addressing relativization, this report demonstrates how most, if not all key doctrines governing the scope of legal authority – the process and the exercising of discretion by public authorities (executive and legislative) – have become relative in the sense that these doctrines are infused with overarching proportionality analyses. The same applies to remedies. The Report proposes to explicitly recognize the presumption that deficient acts – namely, acts that contradict basic public laws – are invalid unless the state or another party convinced a court that, a different outcome would be optimal under the doctrine of relative voidness.
Referring to the introduction of individual rights as group rights, the Report documents this trend and suggests that while equality and group-based analyses are important, courts should not forsake the protection of individuals in their quarrels with the government (provided that these are indeed individuals, and not entities holding considerable leverage over public agencies, including the legislature). Addressing pressure generated by emergency situations and extreme conditions, the Report shows how courts maneuver when they apply jurisprudence, and calls for taking greater care when developing an evidentiary basis for substantiating the presence of extreme conditions, which are not merely fear or a sense of emergency, that may or may not be a sufficient reason for relaxing otherwise stringent legal requirements. Without such care, doctrines (including rights-based doctrines) whose underlying rationale is precisely meant to protect courts against acting under the influence of a perceived sense of emergency would be frustrated. The evidentiary question is not limited to emergencies.
The Report outlines the importance of procedural tools for the establishment of the evidentiary basis that is relevant to exercising judicial review. While District Courts, acting as Courts for Administrative Matters, handle ever-larger portions of public-law litigation in Israel, further thought should be given to ways of equipping them with legal fact-finding apparatuses.
Lastly, the Report argues that the relationships between the central and local governments be revisited because it gives rise to questions regarding the interrelation between elected governments and nominated officials, and between principles that should apply uniformly in Israel and those that should be left for the discretion of the various localities. This, as a currently debated issue, is pertinent in matters pertaining to the Shabbat and other aspect of cultural rights. Here and in other contexts, the role of the legal advisor, serving as a gatekeeper to the relevant state agencies, requires further consideration.
