A Suspensão de Direitos Fundamentais em Estado de Excepção Biopolítico (The Suspension of Fundamental Rights in a Biopolitical State of Exception)

Abstract

Portuguese Abstract: Este artigo analisa, de um ponto de vista jurídico-constitucional, o estado de excepção declarado e executado em Portugal para fazer face à pandemia da COVID-19. Sujeita-se, assim, a uma avaliação crítica os principais diplomas emanados pelos órgaos de soberania durante esse período. Em especial, procuro: (i) propor uma abordagem teórica biopolítica ao presente estado de excepção; (ii) explicar o conceito de suspensão do exercício de direitos fundamentais enquanto forma de permitir a introdução de uma regulação jurídica não vinculada pelas normas de direitos fundamentais; (iii) criticar o desenho normativo dos decretos presidenciais e suas consequências jurídicas; (iv) apontar que, politicamente, há uma tentativa de presidencialização do regime do estado de excepção, bem como, circunscritamente, uma tendência de que "tudo vale" com tal cobertura jurídica.

English Abstract: This article analyzes, from a constitutional law perspective, the state of exception declared and executed in Portugal in the wake of the COVID-19 pandemic. Its purpose is to critically evaluate the decrees enacted by the different State organs during such period. In particular, I seek to: (i) propose a biopolitical theoretical approach to the current state of exception; (ii) explain the concept of suspension of fundamental rights as allowing the enactment of legal regulation not bound by fundamental rights norms; (iii) criticize the normative design of the presidential decrees and its legal consequences; (iv) highlight, from a political point of view, both the attempt to "presidentialize" the constitutional regime of the state of exception and the "everything goes" logic that unfortunately underlies some of the adopted measures.
