תקציר בעברית: במאמר זה אנו דנים בשאלה מהי משמעות המחויבות ל״התיישבות יהודית״ שנקבעה בסעיף 7 לחוק יסוד הלאום. אנו מציעים כי כשאר סעיפיו של חוק היסוד, גם בהקשר של סעיף זה אין חוק היסוד קובע חובות או זכויות בעלות משמעות אופרטיבית. יתר על כן, יש לקרוא את הסעיף ככפוף לחובת השוויון, ובכלל זאת לגבי השאלה האם המונח ״התיישבות יהודית״ מתיר התיישבות ליהודים בלבד. לאחר שאנו מציגים ומעיינים בדרך חקיקת הסעיף, אנו מנסים להתחקות אחר כוונת המחוקק הסובייקטיבית. אנו מזהים שתי אפשרויות פרשניות לסעיף. האחת, בעלת ערך נורמטיבי, לפיה הוראת הסעיף צריכה להתפרש כקובעת את מקומה הנורמטיבי של התכלית ״פיתוח התיישבות יהודית״. עם זאת, אנו מציעים לקרוא תכלית זו באופן המתיישב וההולם את מכלול החובות החוקתיות ובכלל זה החובה לנהוג בשוויון. השניה, היא בעיקרה בעלת ערך הצהרתי. עולה ממנה כי פיתוח התיישבות יהודית הנו ערך רווח ונוהג במדינת ישראל מיום הקמתה. אך עיגונו של ערך זה בחוק היסוד מחייב השוואה כלפי מעלה לפיתוח יישובי עבור מי שאינם יהודים. לאור האמור אנו סבורים כי אין בהוראת סעיף 7 לחוק יסוד הלאום כדי להצדיק שינוי של ממש בכללים קיימים ומוסכמים של שימוש והקצאה טובין ציבוריים, ובכלל זה מקרקעין והטבות מס.

English Abstract: This Article seeks to inquire into the proper interpretation of section 7 of the Basic Law: The Nation State, which states a commitment to “Jewish settlement”. We propose that like the other sections of the Basic Law, this Section does not provide operative obligations or rights. Moreover, the section should be read together with the commitment to equality and non-discrimination. The commitment to equality should also dictate the meaning of the term “Jewish settlement”. After presenting the legislative history of Section 7, we track the legislator’s subjective intent. We identify two interpretive possibilities: The first, according to which the Section should be interpreted as determining the normative location of the promotion of Jewish settlement. However, we suggest that this purpose should be read together with the entirety of constitutional obligations, including the duty of equality. The second, according to which Section 7 is mostly declarative. From it we can deduce the historical value of Jewish settlement in the creation of the State of Israel, which until this point had not been incorporated into the constitutional text. However, we argue that this incorporation requires the leveling up of settlement components for non-Jews. We therefore argue that Section 7 of the Basic Law: Nation State does not justify any significant changes in the extant legal landscape regarding the use and allocation of public goods, including land and tax benefits.
