Abstract

Deutsche Zusammenfassung: Der Beitrag kommt u.a. zu dem Ergebnis, dass das Gesetz zur Bekämpfung von Kinderehen eine verfassungswidrige echte Rückwirkung entfalte; selbst wenn man (wie der Bundesgerichtshof in BGH 14.11.2018 – XII ZB 292/16) nur von einer unechten Rückwirkung ausgehe, sei diese hier unzulässig.

English Abstract: This article’s major conclusion is that the Act on Combatting Child Marriages has the categorical flaw of having unconstitutionally harsh retroactive effects. Even if the expectations with which the law interferes are deemed unsettled—the approach taken by the Federal Court of Justice in its Nov. 14, 2018 decision (case no.: XII ZB 292/16)—it is argued that the law’s retroactive effects are still inadmissible.
