Abstract

Although crypto-asset and distributed ledger technology (DLT) applications have been increasingly piloted and rolled out in the European Union (EU), areas of regulatory fragmentation and legal uncertainty have dampened levels of investment and limited cross-border scaling to-date. The paper considers some of the key issues and goes on to consider European initiatives intended to address these issues, notably the European Commission’s legislative proposals for a regulation on Markets in Crypto-assets (MiCA) and a pilot regime for DLT experimentation in the context of market infrastructure.
