Abstract

German Abstract: Mit dieser Stellungnahme äußern wir uns zu verschiedenen Fragen, die das deutsche Finanzministerium im Rahmen seiner Evaluierung des § 58a des Zahlungsdiensteaufsichtsgesetzes (ZAG) aufgeworfen hat. Die Regelung gewährt ein Recht auf Zugang zur technischen Infrastruktur, die für die Erbringung mobiler und internetbasierter Zahlungsdienste unerlässlich ist. Die Vorschrift wurde als "Lex Apple Pay" bezeichnet, da sie politisch im Ausgangspunkt von der Motivation geprägt war, konkurrierenden Zahlungsanwendungen das Recht auf direkten Zugang zu den NFC-Schnittstellen (Near Field Communication) von Apples Mobilgeräten zu gewähren. Die regulatorischen Auswirkungen gehen jedoch viel weiter, da sie beispielsweise auch die Erbringung von Zahlungsdiensten über Sprachbefehlsgeräte, über mit dem Internet der Dinge verbundene Geräte oder sog. in-car payments betreffen kann.

English Abstract: With this submission we respond to various issues raised by the German Ministry of Finance in the course of its evaluation of Section 58a of the German Payment Services Supervisory Act (PSSA). The provision confers a right to access technical infrastructure that is essential to provide mobile and internet-based payment services. The provision has been dubbed ‘Lex Apple Pay’ as it was saliently motivated by the objective to give competing payment applications the right to directly access the near-field communication (NFC) interfaces of Apple’s mobile devices. However, its regulatory effects go much further as it may also affect, for example, payment services rendered via voice command devices, devices connected to the internet of things or in-car payments.
