Illegal Outsourcing of Workers and Subcontracting in Digital Platform Companies (CESIÓN ILEGAL DE TRABAJADORES Y SUBCONTRATACIÓN EN LAS EMPRESAS DE PLATAFORMA DIGITALES)

Abstract

English Abstract: This article will explain why subcontracting can be clearly detrimental to the workers and may have parallel advantages for the platform companies. Then, the possible qualification of illegal assignment practices will be addressed, based on the exposition of examples taken from several infringement proceedings opened by the Labor and Social Security Inspection. The indications of illegal assignment will be analyzed on the basis of the increasingly restrictive jurisprudential construction of this institution. Fourthly, the most important indications for determining the existence of an illegal assignment in the case of work with platform companies will be extracted. Finally, a finalist interpretation of the institution of illegal assignment will be proposed to allow it to fulfill its functions: that is, to prevent subcontracting from being used as a way of subjecting workers to the "laws of the market".


Spanish Abstract: El presente artículo expondrá por qué la subcontratación puede suponer evidentes perjuicios para las personas trabajadores y paralelas ventajas para las empresas de plataformas. A continuación, se abordará la posible calificación de prácticas de cesión ilegal, a partir de la exposición de ejemplos extraídos de varias actas de infracción abiertas por la Inspección de Trabajo y Seguridad Social. Se analizarán los indicios de cesión ilegal partiendo de la cada vez más restrictiva construcción jurisprudencial de esta institución. En cuarto lugar, se extraerán qué indicios pueden ser los más importantes para determinar la existencia de cesión ilegal en el caso de trabajo con empresas de plataformas. Por último, se propondrá una interpretación finalista de la institución de la cesión ilegal que le permita cumplir sus funciones: esto es, evitar que la subcontratación se use como forma de someter a los trabajadores a las “leyes del mercado”.
