Abstract

Since the creation of Hong Kong’s new constitutional order on 1 July 1997 there has been a number of points in which international law has interacted with domestic constitutional and sub-constitutional norms. The courts have been called upon to resolve questions concerning the relevance of international law as an interpretive aid, the significance of British treaty ratifications to the scope of domestic constitutional guarantees in Hong Kong, the continuing applicability of the common law doctrine of incorporation, and the influence of international norms on the common law grounds of judicial review. This chapter evaluates the relationship between the constitutional and international in post-Handover Hong Kong.
