Abstract

Deutsche Zusammenfassung: Der natürliche Wille wurde 2013 als Rechtsbegriff in das BGB eingeführt. Der Aufsatz untersucht, welche Willens- und Autonomievorstellung dem Begriff des natürlichen Willens zugrunde liegen könnten. Hierzu begrenzt er sich auf den Begriff des natürlichen Willens innerhalb des Rechtsbereichs, der sich mit ärztlichen Zwangsmaßnahmen gegenüber Betreuten befasst. Im Zuge der Untersuchung wird das Verhältnis von natürlichem zu freiem Willen aufgeklärt, die Willensvorstellung Harry Frankfurts rekonstruiert und fruchtbar gemacht sowie auf eine in innere und äußere Autonomie geteilte Autonomievorstellung zurückgegriffen. Zudem wird die Entwicklung der Definition und Funktion des natürlichen Willens rechtshistorisch aufgearbeitet. Damit leistet der Aufsatz einen Beitrag zur begrifflichen Durchdringung des natürlichen Willens.

English Abstract: Natural will was introduced as a legal concept in the German Civil Code in 2013. This paper examines which conceptions of will and autonomy might underlie the notion of natural will. For this purpose, it limits itself to the concept of natural will within the area of law dealing with involuntary medical treatment. In the course of the inquiry, the relationship between natural will and free will is explored, Harry Frankfurt's conception of will is reconstructed and brought to bear, and recourse is made to a conception of autonomy divided into inner and outer autonomy. In addition, the development of the definition and function of natural will is reassessed in terms of legal history. Thus, the essay contributes to the further conceptual establishment of natural will.
