Abstract

Spanish Abstract: Este artículo trata sobre el homicidio, entendido como aquella acción por la que se mataba a otra persona o a uno mismo, teniendo en cuenta que la Iglesia Católica instruía a los fieles que Dios era el legítimo dueño de la vida humana y el único que podía quitarla a su voluntad. En algunos catecismos y manuales se incluía también como homicidio cualquier herida o mutilación de alguna parte del cuerpo. El artículo analiza los debates doctrinales y jurídicos que implicaba esto en relación al buen trato a los naturales americanos, explica las clases de homicidios, sus circunstancias y penas, así como las irregularidades por homicidio, dispensas, la moderación por legítima defensa y la reparación del daño. Finalmente, se presenta un balance historiográfico sobre el tema y los vacíos aún por explorar.

English Abstract: This article deals with homicide, understood as the action of killing another person or committing suicide. The Catholic Church instructed the faithful that God was the legitimate owner of human life and the only one who could take it away at will. In some catechisms and manuals, any wounding or mutilation of a part of the body was also considered homicide. The article analyses the doctrinal and juridical debates on this issue with regard to the prescribed good treatment of indigenous people in Spanish America, it also explains the types of homicide, its circumstances and penalties, as well as the canon law impediments resulting from homicide, the dispensations, the mitigating circumstances due to legitimate self-defense and the possible compensation for damages. The articles concludes with a historiographical overview on the subject matter and the discussion of some research gaps.
