Abstract

What is the relation between law and liberty? It is often said that liberty requires the rule of law (cf. the oft-cited concept of “ordered liberty”), but at the same time, all laws, by definition, constrain liberty. This paper surveys this paradox from three broad political perspectives—conservative, progressive, and libertarian.
