Property Rights and Labour Rights Revisited: International Investment Agreements and the Social Clause Debate

Abstract
This paper compares the debates over a social clause in international investment agreements to the tensions between property and labour rights in domestic legal systems. The treatment of labour standards in the failed attempt to negotiate a Multilateral Agreement on Investment in 1998 is considered and the possibility for greater convergence of approaches since then is analysed.
