Abstract

The paper examines problems related to the GATT and International Environmental Law posed by the dispute between the United States and Mexico over U.S. import prohibitions for tuna which has not been caught in a Dolphin-friendly manner. In particular the Yellowfin Tuna of the Eastern Pacific has been threatened by the use of older and more economical fishing methods. Since the case has been settled, a number of open questions remain, which will be adressed here. The paper concludes with a solution that takes account of both global trade and the regional protection of marine mammals.
