The Deceptive Trade Practices Act 2005 - Still Alive and Well

Abstract

In 1995, the Texas legislature enacted substantial changes to the state's consumer protection law, the Deceptive Trade Practices Act. Prior to these changes the Texas DTPA was one of the most powerful consumer protection statutes in the country. Although many believe the 1995 changes have destroyed the DTPA as an effective tool for consumers, that is not the case. This article discusses the 1995 changes and demonstrates that although the DTPA is not what it used to be, it is still a powerful weapon for consumer attorneys.
