Immigrant Visa Distribution: The Case of Mexico

Abstract

Facially neutral criteria limiting access to U.S. immigration visas have a disparate impact on Mexicans. U.S. immigration policy that is insensitive to demand helps create the conditions that lead to the undocumented migration of Mexicans. This Article explores the rules conditioning visa availability and argues that U.S. immigration policy should become more sensitive to demand by accounting for prior U.S. acts that explain Mexican demand for visas.
