Are You Being Served?: E-Mail and (Due) Service of Process
35 Pages Posted: 1 Apr 2007
Abstract
The article focuses on the issues raised in considering the feasibility of email service of process to give defendants notice of legal proceedings instituted against them in United States courts. The article argues that electronic service should be permitted in a particular range of civil cases, namely those in which the defendants have established a connection to an email address such that the electronic service of process is reasonably calculated to apprise defendants of the actions against them.
