Abstract

This article examines the recent controversy involving appellate courts in Queensland, Victoria, Western Australia and New South Wales as to the liability of a registered proprietor of Torrens title land under the law stemming from Barnes v Addy. It explains the divergence of views as to the nature of an action against a person benefiting from a breach of trust or fiduciary duty, focusing on the situation where the benefit received is an interest in Torrens title land.
